Die Beweiswürdigung stellt nach herrschender Meinung in der juristischen Literatur ein 'Geheimnis' des Tatrichters dar. Obwohl man in die Sollvorschrift des§267 StPO eine Mussvorschrift hineinliest und anschließend eine Urteilsbegründung erfordert, ist es der Sachverhaltsfeststellungsdogmatik noch nicht gelungen, dem Tatrichter einen detailreichen Beweismechanismus bereitzustellen. Und die Antwort auf die Frage, was für Anforderungen an den Beweis zu stellen bzw. unter welchen Umständen die jeweiligen schuldausschließenden Alternativen als (un-)vernünftig anzusehen sind, wird der Willkür überlassen. Der Autor unternimmt einen intensiveren Zugriff auf den Beweiswürdigungsvorgang und arbeitet eine anpassungsfähige Begründungsstruktur heraus, die dem Tatrichter epistemische Rechte und Pflichten vorschreibt. Der hier vertretene Inferentielle Kontextualismus gelangt zu ähnlichen Ergebnissen wie die höchstrichterliche Rechtsprechung, versieht sie aber mit einer tragfähigen erkenntnistheoretischen Basis zwecks einer überprüfbaren Beweisanalyse.
