Zu diesem Kern gehört allerdings nicht der Schutz der abhängigen Arbeit, der jedoch die Funktionsgarantie der europäischen Marktwirtschaft darstellt. Aus diesem Grund vertieft die Europäische Verfassung das nationale Sozialstaatsprinzip: sie verankert das Prinzip des nachhaltigen Sozialstaates. Sie konkretisiert es zudem durch das Sozialrecht auf Mitbestimmung. Außerdem erweist sich die EU als globaler Akteur: der schrankenlosen Weltmarktwirtschaft setzt sie die soziale Weltmarktwirtschaft entgegen.
