Recht und Willkür war das Thema des Akademientages 2012 in Hannover. Die hier abgedruckten Vorträge und das Streitgespräch fächern das Thema in einzelnen Rechtsgebieten und am Beispiel historischer Ereignisse näher auf. Behandelt wird die Ambivalenz des Willkürbegriffs als Machtmissbrauch einerseits und andererseits als Willensfreiheit im Sinne von Kant. Es geht um Revolutionen gegen Willkür mit der Gefahr neuer Willkür, um Rechtsstaat und Unrechtsstaat und um die Gefährdung der Vermögensordnung durch private Spekulation und staatliche Überschuldung. Angesichts neuer Herausforderungen des internationalen Menschenrechtsschutzes werden Ausweitungstendenzen bezüglich der Inhalte, der Adressaten und der Schutzmechanismen beurteilt. In einem Streitgespräch werden humanitäre Interventionen gegen Menschenrechtsverletzungen im großen Stil unter völkerrechtlichen Gesichtspunkten erörtert.
