Damit verzahnt ist die Frage, welcher Prüfungsumfang dem zuständigen (Restrukturierungs-)Gericht in diesen Verfahrenssituationen zukommt. Diese Arbeit befasst sich mit der Frage, bei wem die Verantwortung für die Schaffung der Tatsachengrundlage innerhalb der 64 und 66 StaRUG liegt.
