In diesem Buch werde ich die Gründe für die Entscheidung des EuGH im West Tankers Urteil und gleichnamig die Zukunft der Anti suit injunctions erörtern. Durch dieses Urteil wurde ein Prozessführungsmittel des Common Law angegriffen, welches über viele Jahre erfolgreich angewandt wurde, zum Schutze und Durchsetzung von Schiedsvereinbarungen. Nach kontinentaleuropäischer Ansicht verstoßen die anti suit injunctions gegen den Grundsatz der Gemeinschaftstreue. Inwiefern diese Art der Unterlassungsverfügung europarechtskonform ist und in Zukunft sein wird, ist hierbei zu klären. Desweitern muss man sich fragen, was diese Entscheidung des Europäischen Gerichtshofes für die internationale Schiedsgerichtsbarkeit bedeutet und in welchem Ausmaße diese davon betroffen sein könnte.
