GWB-Novelle hat der deutsche Gesetzgeber 19a GWB geschaffen und sich dafür entschieden, den Unternehmen mit überragender marktübergreifender Bedeutung für den Wettbewerb diesbezüglich die Darlegungs- und Beweislast aufzuerlegen. In dieser Arbeit werden die Gründe herausgearbeitet, aus denen sich der Gesetzgeber - auch in Abgrenzung zum Digital Markets Act - für diese Ausgestaltung entschieden hat. Darüber hinaus werden die Gründe systematisiert, auf die sich Unternehmen zur erfolgreichen Führung der sachlichen Rechtfertigung berufen können sowie die Zulässigkeit und Grenzen der Übertragung der Darlegungs- und Beweislast herausgearbeitet.
